PHILIPPINES: Government employees, including those in government-owned or government-controlled corporations, will now receive night differential pay following outgoing President Rodrigo Duterte’s signing of the measure into law.
The President signed Republic Act No. 11701, which grants government employees (permanent, contractual, temporary, or casual) a night shift differential of a maximum of 20% of their basic hourly pay. Work shift covers hours between 6 pm and 6 am.
Employees who are not entitled to the night differential pay are those whose duty hours fall between 6 am and 6 pm. They are paid overtime pay for excess hours worked.
The new law also does not cover employees who are on-call 24 hours a day (personnel of the Armed Forces of the Philippines, Philippine National Police, Bureau of Jail Management and Penology, and Bureau of Fire Protection, among others).
Moreover, the additional payment will not lead to any reduction of the benefits and allowances being currently enjoyed by government employees.
Senator Christopher Lawrence “Bong” Go said the new law is an effort to recognize the sacrifices of government employees, especially health care workers. He calls on the private sector to show the same recognition for their employees, especially those who were affected by the Covid-19 pandemic.
